Dublin District Court

If you are summonsed to appear at Dublin District Court, no matter how minor the matter may seem, you should seek legal advice.

Solicitor for Dublin District Court

Located at the Criminal Courts of Justice, Dublin District Court deals with matters, such as; enquiries relating to outstanding bench warrants, court dates, court results, bail applications / approval of sureties, lodgement of appeal, legal aid, applications for copy orders and police property applications are dealt with on a daily basis.

Administrative back up is provided to the court by way of issuing remand /committal / trial / extradition and bench warrants. Appeals are processed and legal aid claims are certified for payment.

All criminal prosecutions are initiated in the District Court with the exception of certain offences dealt with by the Special Criminal Court (generally offences against the State). All offences fall into one of three categories:
  1. Summary: an offence which can be dealt with by a judge sitting without a jury.  Most road traffic offences (such as those relating to speeding, parking and insurance) and public order offences are always dealt with in the District Court.
  2. Indictable: an offence which must generally be tried before a judge and a jury. Some indictable offences can never be dealt with in the District Court – e.g. murder and rape.  These are commenced in the District Court but are sent forward to a higher court for trial/sentence. Other indictable offences can be dealt with in the District Court provided certain procedures are followed.
  3. Hybrid: an offence which can be dealt with either in the District Court (summarily) or in a higher court (on indictment).  The legislation will state the difference punishments on summary conviction and on indictment.

District Courts deal with the following types of procedural matter, on a daily basis:

  • garda applications for warrants of arrest or search
  • applications under the Police (Property) Act, 1897
  • applications for Free Legal Aid

About Garda Station Interviews

If you are attending a Garda station to give a statement or to be interviewed, You require a solicitor. Regardless of your innocence or guilt, it is important that you have a solicitor present to ensure your rights are protected. Garda Stations can be hostile and intimidating.  Most people have never been arrested.  An arrest is a terrifying experience.  It is frightening and isolating.  The whole process of arrest and detention for 6 hours, 12 hours, 24 hours and in some cases for longer will place you under maximum psychological and emotional pressure.  The Gardai may make you feel like you have to say something that you do not want to say.  You do not have to say anything, even if you have been arrested, it is your legal and constitutional right to say "no comment" to every question, even to questions that appear innocuous.
Our solicitors will attend with you at any Garda Station in Ireland, and ensure that your rights are protected

information you need before giving a statement to the guards

If An Garda Síochána want you to attend at a Garda station for them to speak to you, it's probably because you have been accused of being involved in a crime, in some way. Gardai will only take statements from people when investigating a  potential crime. They may be trying to ascertain if the information they have gathered is true, in full or in part, so, if they want to speak to you, in a Garda station, you have been linked to a crime in some way. They can ask you to attend voluntarily at a Garda station, to give a statement or be interviewed, even if you are a suspect. It is vital that you obtain legal advice in advance of speaking to the Guards or giving them any statement.
